Terms of Service

1. Scope

These terms of service (the "Agreement") govern the use of the information and services provided by Techmap GmbH, Welfenstr. 32, 76137 Karlsruhe, Germany (hereafter referred to as "Techmap", "us", or the "Service Provider") via the website: techmap.io (as well as any subdomains or product-related domains such as jobdatafeeds.com) (hereafter referred to as the "Website") by the user (hereafter referred to as the "User" or "You").

This Agreement does not govern the relationship between You and Techmap for purchased Data. Such relationship is governed by a separate legal agreement signed between you and Techmap regarding the purchase of Data.

2. Services

The Service Provider provides an online platform (the "Platform") that enables Users to access information, resources, and services related to the Service Provider and its services (the "Services").

3. Use of the Platform

The User may use the Platform and access the Services solely for lawful purposes and in compliance with this Agreement and applicable laws and regulations. The User shall not use the Platform in a manner that could damage, disable, overburden, or impair the Platform or interfere with any other party's use and enjoyment of the Platform.

3.1. Acceptance of Terms of Use

This Agreement shall be effective as of your first access or use the Website and shall remain in effect for so long as You use or access the Website and any of its Services.

By accessing or using the Services, You agree that You have read, understood, and agree to be bound by the Terms of Use, which incorporates the Privacy Policy whether or not You are a visitor, registered user, affiliate, client, partner, or customer of the Services.

3.2. Termination

The Service Provider may terminate this Agreement and the User's access to the Platform and the Services at any time without notice and without liability.

4. Intellectual Property

The Service Provider retains all rights, title, and interest in and to the Platform, the Services, images, materials, content, and all related intellectual property rights. The User acknowledges that the User does not acquire any ownership rights in the Platform or the Services. You are granted limited license only for purposes of viewing the material contained on this Website.

Techmap owns and retains all proprietary and intellectual property rights in the Services We provide. Techmap® is a registered trademark of Techmap GmbH. You are not permitted to use our trademark or logo without our prior written consent. All rights, including copyright, trade secret, patent, and trademark law, in all material and content stored, displayed, and accessible through the Services is either owned by Techmap or duly licensed from third parties. All such intellectual property rights are reserved.

5. Limitation of Liability

The Service Provider shall not be liable for any direct, indirect, incidental, special, exemplary, punitive, or consequential damages or for "lost profits" arising out of or in connection with the use of the Platform or the Services, even if the Service Provider has been advised of the possibility of such damages (including without limitation, negligence, tort, contract, or strict liability).

Techmap's cumulative liability to you or any other person or entity for any loss or damage resulting from any claims, demands, or actions arising out of or relating to the websites and services or this agreement, including but not limited to dissatisfaction with any of our services, regardless of the legal theory, shall not exceed one hundred dollars ($100.00).

5.1. Warranties

While Techmap endeavors to provide reliable information, services, and content, our Services are provided on an "as-is," and "as available" basis and may include errors, omissions, or other inaccuracies.

Techmap specifically disclaims any warranties, express or implied, including, without limitation, the warranties of accuracy, noninfringement, merchantability, and fitness for a particular purpose, and any warranties that may arise due to course of performance, course of dealing, or usage of trade. Techmap makes no warranty that:

1. Techmap Services will meet your requirements;
2. our Services will be available on an uninterrupted, timely, secure, or error-free basis; or
3. the presented data that may be obtained from the use of Techmap Services are accurate or reliable.

You also acknowledge and agree that the operation of the Websites is dependent upon the proper and effective functioning of the internet and other third-party equipment and services, and we do not guarantee and will not be liable for these in any way.

5.2. Indemnity

You agree to defend, indemnify, and hold harmless Techmap and its officers, directors, board members, board advisors, employees, partners, agents, successors, and assigns from and against any loss, liability, claim, injury, damage, demand, or expense (including reasonable attorneys' fees and costs) relating to or arising from your breach of any provision of this Agreement, or your use of the Services.

6. Applicable Law

This Agreement shall be governed by and construed in accordance with the laws of the Federal Republic of Germany.

6.1. Dispute Resolution

Any disputes arising out of or in connection with this Agreement shall be resolved by the competent courts of Germany. Unless submitted to arbitration, all claims, legal proceedings or litigation arising in connection with the Service will be brought solely in Karlsruhe, Germany, and you consent to the jurisdiction of and venue in such courts and waive any objection as to inconvenient forum.

6.2. Changes and Amendments

For important reasons, in particular in the event of changes to statutory provisions, judicial precedences, the Software or market conditions, Techmap may notify the Customer of changes to these Terms. The changed Terms shall be deemed to have been agreed if the Customer has not objected to the change within one month upon receiving a notification and Techmap has explicitly notified the Customer of this change. The most current version will always be available on our Website. By continuing to access or use the Service after those changes become effective, you agree to be bound by the revised Terms.

The Service Provider may amend this Agreement at any time by posting the amended terms on the Website. The User's continued use of the Platform and the Services after the posting of such amended terms shall constitute the User's consent to such amended terms.

6.3. Severability and Waiver

If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

The failure of Techmap to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
